Our Derech Halimud shiur today will address different structures: One, הדין חל ע"י מעשה האדם ומדעתו או הדין חל מאליו ע"י המציאות And two, דין ספק או דין ודאי. Re: the first half of the shiur, we will address the sugya of Muktza and the debate between R' Yehuda and R' Shimon, does a foodstuff require an active designation (הכנה) meaning, דעתו של אדם, or is the הכנה חל מאליו, meaning the object "prepares itself"? We will study the sugya of קניני גזילה and wonder about the difference between (a) the גזלן actively destroyed the גזילה, and (b) the object was destroyed without his action. For the second half, we will discuss the case of a doubtful heir (ספק יורש); the sugya of a doubtful murderer (ספק רוצח); and the ספק נוגע בעדות.
