Is the דין generated by the action & the בעל המעשה? Or is the action secondary & the דין is generated מאליו, as a result of the reality itself? The 2nd definition = the law is determined by the state of being; the action plays the role of generating a state of being. Our examples for today will include: 1, the obligation to recite Birchas HaMazon, what generates the obligation, the act of אכילה or the sate of satiation that results from the אכילה? If the latter, we can drop the universal Halachik conditions that define אכילה & qualify it. 2, the case of the Kohen who brought about the death of a fellow Jew & is hence disqualified for Nesias Kapayim. A פסול הגוף resulting from the state of being caused by the Kohen. 3, מקח טעות in sales.
