Description

For Masechet Bava Kamma 95a, we will analyze two approaches to the opinion of Rebby Meir re: the obligation of the thief to return the cow & the calf, the sheep & its shearings. Is it that שינוי is inoperative? Or is it that although the Gazlan acquired the stolen object thru שינוי, nevertheless, the Rabanan instituted a Takana, a penalty (קנס) that requires the Gazlan to return the calf & shearings. Note: in the case of returning a stolen Eved who got old, Rebby Meir holds that הפקעת גזילה in the case of קרקע depends upon שם קרקע; whereas the Chachamin maintain that it is חפצא של קרקע which generates הפקעת גזילה & an Evid in 'cheftza' is מטלטלין.
