Description

For Masechet Bava Kamma 94b we begin with an analysis of Rebby Yochanan's view on Shinui. This will lead to the definition of shinui as a Rabbinic establishment rather than a Torah law. We will study Rebby's Takana to allow for Kinyan Shinui in order to entice robbers & loan sharks to repent. Was this Takana established exclusively for the generation of Rebby? Are there situations in which the robber and his victim should be encouraged to pay compensation?
