Description

For Masechet Beitza 3b & Yoreh Deah siman #102: דבר שיש לו מתירין, we will dedicate this shiur to understand a difficult Rashba. The Rashba applies the principle of דשיל"מ to the case of an egg that was laid by a hen which may have been a טריפה that fell into a Taaroves. The Machtzis Hashekel quotes the objection of the Tzemach Tzedek: we will find out one of two things. Either the hen was not a טריפה and the egg was always permissible, or the hen was a טריפה and the law of Bitul applied. There is no room to fit in the principle of דבר שיש לו מתירין. We will study the answer of the Talmid HaMaskil, and of the Tzemach Tzedek himself. This will require an analysis of one who violated a Safek Issur & later it became clear that it was Heter.
