We open the 3rd Perek of Masechet Berachot, מי שמתו מוטל לפניו, & analyze the first Mishna. Our analysis will require that we categorize the various Dinim in the Mishna by defining the nature of the exemption from Mitzvot. Are we dealing with the classical exemption of העוסק במצוה, or are we dealing with a particular category that applies to מי שמתו מוטל לפניו in particular? We will study Rashi, the Rambam and Tos' in the name of the Yerushalmi. The נפק"מ will be: does the Avel have the option of volunteering to fulfill the mitzvot, or is he absolutely enjoined from doing so?
