In this Halacha shiur for Parshas Mishpatim, we study the section on Nezikin, the Laws of damages, specifically the principle that governs Adam HaMazik, i.e. Adam Mu'ad LeOlam. At the face of it this rule means that man is always responsible to compensate for all or any damages he causes with his body, even if there was no negligence on his part. In the language of the Mishna he is responsible for 'shogeg' meaning 'with no intention to damage', but the language of the beraisa indicates that he pays for 'ones', i.e. circumstances beyond his control. In this shiur we will study the view of the Ba'alei HaTos' who subdivide 'ones' into two categories, the most extreme of which is 'ones gamur ke'ein geneva' for which man is exempt from payment.
