Description

We will study the controversy between Rashi & the Rambam regarding a Kesher She'eino shel Kayama, is such a knot prohibited MiDirabanan? We have two categories of exemptions in Meleches Shabbos: a general Halacha in all Melachos of Shabbos ('Meleches Machsheves'), and a specific P'tur in one Melacha. In the latter case, the very essential condition that defines the Melacha is lacking. In the first category we generate an Issur DeRabanan; in the second category the action is permissible LeChatchila. A Melacha that is less than permanent, e.g. writing with fruit juice, is Patur Aval Assur as a P'tur Shabbos. What is the status of a Kesher She'eino shel Kayama in the Mitzva of 'U'Keshartem' in Tefillin or tying the know of Chalitza?
