We will analyze the nature of the Takanas Chachomim to read 3 Parshiot of Shema according to Rashi and Tos'. Did the Rabanan institute the requirement to recite the 2nd & 3rd parshiot as part of the mitzvah of Tefilla or as an extension of the mitzva of Kriat Shema? The difference will be regarding zmanei Kriat Shema: does Tefilla determine the zman for the Derabanan of 3 parshiot, or does Kriat shema determine the zman? This will impact upon another aspect of the Takanas Chachomim, i.e. Birchat Kriat Shema. Rashi can justify the reading of Shema before Tzeis HaKochvim in the Beis HaKneset since we are dealing with the mitzva Derabanan of kriat shema which is a Kiyum Tefilla as part of Maariv. Tos' cannot accept Birchat K"S before Tzeis.
