Description

The rule of HaPeh SheAsar Hu HaPeh SheHitir applies when a woman declares Shevuya Hayisi U'Tehora Ani or Ashes Ish Hayisi U'Gerusha Ani. In this shiur we will study the controversy amongst the Rishonim as to whether or not she is only believed Tosh Kedei Dibbur, i.e., when her Peh SheHitir was declared immediately following the Peh SheAsa, or whether she would be believed even later on. We will analyze HaPeh SheAsar: is it a Migu, or a new Din of Ne'emanus granted to the individual who is the only source for the Issur to begin with.
