Description

The mitzva incumbent upon the rapist to marry his victim cannot override the negative commandment enjoining one from marrying a mamzeret whose marriage is normally prohibited. The rule that "Aseh Doche Lo Taaseh" is suspended because of the nature of the mitzva of "Lo Tihiyeh LeIsha" because of the leniency in this mitzva, namely, the fact that the mitzva is contingent and not absolute. In this shiur we will analyze two opinions in the Rishonim as to why Kibbud Av would override a Lo TaAseh despite its contingent nature.
