Description
In the context of our study of the nature and scope of the obligation to separate another from the violation of an Issur, we will analyze the controversy between the Rambam and the Rosh regarding the halachak requirement to remove a garment of Kelaim even in front of the public eye. The Rambam maintains that kavod HaBriyos cannot override a violation of an Issur Deoraisa even if it means that Reuvain will strip Shimon of the sha'atnez the latter is wearing in a public place. The Rosh will require that if Reuvain is wearing sha'atnez he (Reuvain) must remove his garment. But Reuvain will not strip Shimon if Shimon is wearing sha'atnez since Shimon is only a Shogeg & not a Meizid.
