In this weeks Parsha we talk about the zealous act of Pinchas to stab the sinful couple while they were in the act. The Sifre says that one of the miracles that happened to Pinchas was that no blood spilled on him in order that he [a Kohen] shouldn't become Tamei. This implies that they died when Pinchas stabbed them and was still holding on to the spear. However the Gra had in his text that another miracle happened to Pinchas that they didn't die until Pinchas went away so that he wouldn't be Tamei. 




 




Rabbeinu Bechaye asked why he didn't become Tamei for touching a כלי that was touching a מת and thus had the status of טומאה בחיבורין [we will explain that in a moment]. He answered that the spear was a פשוטי כלי עץ [flat wooden utensil] that is not susceptible to Tumah. Then he quotes the Medrash that they didn't die until after Pinchas went away. 




 





So in light of this Rabbeinu Bechaye, our topic is טומאה בחיבורין. 



 



The Gemara [Avoda Zara 37b and Nazir 42b] teaches that there is a halacha of טומאה בחיבורין which means that even though one who touches a dead body is an אב הטומאה and the person who touches him is a ראשון לטומאה, nevertheless if the second person touched the first person while he was touching the מת, then he becomes and אב הטומאה and is טמא for seven days. See there!!



 



Chakira: What is the חידוש of טומאה בחיבורין? 




 




A] "Rob" who is touching the מת becomes like the מת and [as he is touching] is thus an אבי אבות הטומאה. "Phil" who touches Rob is considered that he is touching the מת because touching Rob is like touching the מת. Automatically ["ממילא"] - Phil becomes an אב הטומאה. 




 




B] Rob is the "middle man" that connects Phil to the מת. Phil becomes an אב הטומאה because we view him as if he touched the מת itself. According to this approach - Rob is merely an אב הטומאה and not אבי אבות like the מת.  



 



A few Nafka Minahs [if you ever need to rhyme "Nafka" I would suggest "davka" or [Franz] "Kafka"]:



 



1]  Tosfos in Shabbos [י"ז. ד"ה ששמע] say that even חיבורי אדם בכלים - a connection of a person to כלים creates טומאה בחיבורין. So if a כלי is touching a מת and a person touches the כלי, he will be טמא. The question is - what is the din if a כלי חרס [earthenware vessel] touched a מת and a person touched the כלי חרס. A כלי חרס can't become an אב הטומאה [Eiruvin 104b]. According to the first possibility we raised, since the כלי חרס can't become an אב הטומאה, the person who touches it will be completely טהור. Since the טומאה of חיבורין is that touching the connector makes one טמא because the connector is an אבי אבות  - in a case of כלי חרס there will be no טומאה because it can't become an אב הטומאה. 




 




According to the possibility B, one would PRESUMABLY become טמא because while the כלי חרס itself can't be an אב הטומאה it CAN connect the person to the מת. 



 



 [ואל תתמה היאך יתכן דהנוגע בכ"ח מקבל טומאה ע"י הכ"ח יותר מהכ"ח גופא, דכבר מצינו כן בדין ידות לטומאה, דלחד גיסא בחולין קכ"ח א' בע"ח אע"פ שאינו מקבל טומאה נעשה יד לאבר המדולדל ואם טומאה נגעה בבהמה נטמא טומאה מ"מ יכול להעביר הטומאה לנוגע השני].




 




2] The din is that  כלים don't become טמא when they carry a dead body [טומאת משא] as the Rambam rules [טומאת מת א-ט]. What is the din if a person touches a כלי that is carrying a מת?? If you learn the first way the person won't be טמא [since the כלי isn't טמא]. According to the second approach he will be, since the כלי connected him to the מת. 




 




3] The  din is that metal utensils [כלי מתכת] that touch a dead body become אבי אבות הטומאה [because the rule is חרב הרי הוא כחלל - the sword is like the dead body]. What is the din if a כלי מתכת touches a person who is in contact with a מת? According to the second way that טומאה בחיבורין means that one is actually in contact with the מת, then the כלי מתכת would become אבי אבות הטומאה. 




 




According to the first way the כלי will only be an אב הטומאה. Even though the connector [i.e. the person] is an אבי אבות הטומאה when in contact with the מת and the כלי מתכת is on contact with this person, it doesn't matter. A כלי מתכת only becomes an אבי אבות הטומאה when in contact with a מת itself and not when in contact with any other אבי אבות הטומאה. 




 




ושו"מ דהחזו"א ז"ל באהלות סי' י"ג סק"ו יליף מדברי מרן הכ"מ ז"ל בפי"ז מטו"מ ה"ה, דכלי הנוגע בכלי שנוגע במת נעשה הכלי השני אבי אבות משום טומאה בחיבורין וחרב ה"ה כחלל, ותמה עליו דלא מצינו טומאה בחיבורים לעשות אבי אבות והוכיח כן מכמה מקומות יעו"ש היטב. ולהנ"ל י"ל דפליגי בב' צדדי הספק, דדעת מרן הכ"מ ז"ל דטומאה בחיבורין מחשיב הנוגע השני כנוגע במת עצמו ולפיכך הכלי השני נעשה אבי אבות, ודעת החזו"א ז"ל דגדר טומאה בחיבורין אינו מחשיב הנוגע השני כנוגע במת עצמו וכנ"ל.




 




It turns out that this Chakirah is actually a מחלוקת ראשונים. [See especially what I bolded]: 




 


המפרש ז"ל בנזיר מ"ב ב' ד"ה והא, כתב וז"ל "אם אדם נוגע ידו במת ואוחז בו וידו אחרת נתונה ביד חבירו וכו' שיהא גם אותו חבירו כמי שהוא מחובר ונוגע בטומאה זו" ומבואר דס"ל כהצד השני דע"י החיבורין נחשב השני כנוגע במת עצמו, וכן מבואר מדברי התוס' רי"ד ז"ל בע"ז ל"ז ב' כשביאר דברי הסוברים דטומאה בחיבורין לאו דאורייתא וז"ל בא"ד "כד מיחבר ראובן בטומאה ונגע שמעון בראובן חשבי' לי' לשמעון כאילו נגע בטומאה שראובן הוא מחובר בה", וכך נראה מדברי הר"ן ז"ל בחי' לנדה נ"ז א' ד"ה ודילמא.


 


אמנם הרמב"ן ז"ל בע"ז ל"ז ב' ד"ה הא כתב וז"ל "דחיבורי אדם במת דאורייתא כלומר שכ"ז שהאדם מחובר במגעו למת הרי הוא כמוהו והנוגע בו בין אדם בין כלים טמא טומאת ז" ומוכח להדיא כהצד הראשון דהנוגע במת נעשה אבי אבות וכן מבואר מדברי הריטב"א ז"ל בשבועות י"ז ב' בד"ה ואיכא בא"ד וז"ל "וכשחוזר ונוגע במת האחר והוא נוגע בו בחיבורין הנוגע בו הי' טמא טומאת אב כאילו נגע במת עצמו כי האדם בחיבורי המת דינו כמת להיות אבי אבות".
