Kiddushin With An Item Taken Without Permission That The Owner Doesn't Care About

The Tur [סי' כ"ח] writes in the name of the Rambam [אישות ה ח] that if someone married a woman with an item that the owner of the item is not particular [מקפיד] about [without permission], like a date or cashew, it is a ספק קידושין [doubtful marriage]. The Prisha writes that the reason there is ספק קידושין is because we are talking about a where it is not worth a שוה פרוטה and we suspect that maybe it is worth a פרוטה elsewhere such as in a place called Madai [see Kiddushin 12]. But if it is worth a פרוטה, since he wasn't מקפיד and he thus forgave the item and it belongs to the taker, she is מקודשת. The Noda Bi-yehuda [אבן העזר נ"ט] wondered, who cares that he wasn't מקפיד! As long as he hasn't explicitly released the item from his possession and made it הפקר, how does it go away from him? It therefore remains בחזקת מרא קמא - In the possession of the original owner.  The Avnei Miluim [28-49] argues with the N.B. and says that something the owner is not מקפיד on is not הפקר but rather as a GIFT - that a person is willing to give a small item to someone unwittingly as a present. As we find in Succah [42b] that we teach people to say "whomever gets my lulav receives it as a gift" [see there]. From the Prisha it also looks like it is not הפקר but מחילה.  


 


 


 


א) בטור אהע"ז (סי' כ"ח), וכתב הרמב"ם קדש בדבר שאין בעל הבית מקפיד עליו כגון תמרה או אגוז הוי ספק קדושין עכ"ד. כן הוא ברמב"ם (פ"ה מאישות ה"ח). וכתב הפרישה (סקמ"ב), הא דהוי רק ספק קדושין, משום דמיירי שאינו שוה פרוטה, וחיישינן שמא שוה פרוטה במדי, אבל אם יש בו שוה פרוטה, כיון שלא קפד עליו ונמצא שמחלו לו והוי שלו לגמרי עכ"ד. ובשו"ת נודע ביהודה (קמא אהע"ז סי' נ"ט) תמה, דמה בכך שאינו מקפיד, מ"מ כל זמן שלא הפקירו בפירוש במה יצא החפץ מרשותו מחזקת מרא קמא עיין שם. ובס' אבני מלואים (סי' כ"ח סקמ"ט) השיג על הנודע ביהודה, וכתב דבדבר שאינו מקפיד עליו לאו מטעם הפקר אתינן עלה אלא דהוי בתורת מתנה, שנותן דבר מועט למי שיטול שלא מדעתו, וכהא דסוכה (מב ב) מלמדים אותם שיאמרו מי שיגיע לולבי לידו הרי הוא לו במתנה ומי שיזכה בו יהיה שלו עיין שם. וכן נראה מדברי הפרישה הנ"ל דמטעם מחילה אתינן עלה. 


 




 


It is truly a wonder on the aforementioned Geonim that they didn't cite the gemara in Pesachim [6b] that says:


 


 "סופי תאנים בזמן שאין בעה"ב מקפיד עליהם מותרין משום גזל ופטורין משום מעשר" 


 


 


 


Figs that are of inferior quality that the owner doesn't care about are permitted to take and exempt from מעשר. Rashi explains that הפקר is exempt from מעשר. We see explicitly that something that he is not מקפיד about is הפקר. If so, when he takes it, he receives it from הפקר, it is his and he can thus marry a woman with it. We see the same principle in Bava Kamma [119b] that wool that comes up from a flood belongs to the finder. Rashi explains that it is a דבר מועט  - a small item and the person is מפקיר it. Again - something that a person is not מקפיד about is הפקר. Why didn't the Noda Bi-yehuda and Avnei Miluim quote these sources?


 




 



ב) ויש לתמוה על הגאונים הנ"ל, שלא הביאו מהא דפסחים (ו ב) סופי תאנים בזמן שאין בעה"ב מקפיד עליהם מותרין משום גזל ופטורין משום מעשר, ופירש"י דהפקר פטור ממעשר. הרי בהדיא דדבר שאינו מקפיד עליהן הוי הפקר. וא"כ כשזכה בו הרי הוא שלו כזוכה מן ההפקר ויכול לקדש בו. וכן יש להוכיח מהא דבבא קמא (קיט ב) צמר העולה משטף המים הרי אלו שלו, ופירש"י דדבר מועט הוא ואפקורי מפקר ליה עיין שם, הרי דדבר שאינו מקפיד עליו נעשה הפקר, והרי הוא שלו שקנאו. וכן בגמרא שם מסתתי אבנים אין בהם משום גזל, מפסגי אילנות בזמן שאין בעה"ב מקפיד עליהם הרי אלו שלו עיין שם. ותמוה שהנודע ביהודה והאבני מלואים ז"ל לא הביאו כלל מסוגיות אלו. 


 


The Noda Bi-yehuda [אבן העזר ע"ז] quoted what it says in Choshen Mishpat [359-1] that something that someone is not מקפיד upon is permitted to take and there is no גזל. Note that the Shulchan Aruch says that it is permitted to take but not that it belongs to the taker. We see that even though it is permitted to take and there is no גזל because the owner doesn't care, nevertheless it doesn't belong to the taker, for as long as the owner has not explicitly been מפקיר the item, it does not belong to the taker. This concept is expressed by the the Magen Avraham [637-3], who writes in the name of the Sefer Ha-Yereim, that even according to the opinion that גזל עכו"ם is מותר, nevertheless it is not called "לכם" [yours] - see the teshuva inside. 


 


 


 


So we see that the N.B. was conscious of the fact that if the owner is not מקפיד there is no גזל, but said that the woman is not married because he didn't acquire the item as his own.  


 


 


 


ושוב ראיתי בשו"ת נודע ביהודה תנינא (אהע"ז סי' ע"ז) שכתב, דמש"כ בחו"מ (סי' שנ"ט ס"א) דבדבר דליכא מאן דקפיד שרי ליטול דליכא משום גזל, הנה אף דשרי ליטול וליכא גזל דמסתמא אין בעה"ב מקפיד, מ"מ לא זכה הנוטלו להיות חשיב שלו, דכל זמן שלא הפקירוהו בעליו בפירוש אי אפשר לזכות בו, וכמש"כ המג"א (סי' תרל"ז סק"ג) בשם יראים דאף למ"ד גזל עכו"ם מותר מ"מ לא מקרי לכם עיין שם. הרי שהרגיש דקיי"ל דדבר שאין בעה"ב מקפיד אין בו משום גזל, אלא שכתב דמכל מקום אינה מקודשת כיון שלא קנאו. 




We see that on one hand the halacha is that one can be מקדש a woman when he takes something the owner doesn't care about [as we saw at the outset]. On the other hand, the halacha [that we just saw] is that such an item doesn't belong to hi. So how is she married?? This question can be resolved based on the Ran [Kiddushin 58a] who explains the law that if one sold items that are אסור בהנאה and married a woman with the proceeds she is married, even though the money is forbidden to the man marrying her. The reason is that since the woman acquires the money because of the man [and the money is permitted to her] - she is lawfully married [and it doesn't matter to us that the man married her with something from which he may not benefit]. We see that when it comes to Kiddushin, the money need not belong to the מקדש. The same would then apply to a case where he married the woman with money that the owner doesn't care about. Even if we say that the מקדש did not formally acquire it, nevertheless, since the woman derived benefit from the item because of the man-מקדש [for she may eat this date], she is married.   


 


 


 


ג) אולם קושיא זו יש ליישב, על פי מה שכתב הר"ן קדושין (נח א), דהא דבאיסורי הנאה אם מכרן וקדש בדמיהן מקודשת, ואף על גב שהדמים אסורין למקדש, מכל מקום כיון שהאשה קנאתו מחמת המקדש הרי זו מקודשת עיין שם. ומבואר דבקדושין אין צריך שיהא ממונו של המקדש, דהעיקר שהאשה תהנה מחמתו של המקדש ועי"ז היא מקודשת. וא"כ הוא הדין כשקדשה בדבר שאין בעה"ב מקפיד, אפילו אם נימא דלא קנאו המקדש, מכל מקום כיון דעכ"פ האשה נהנית מהדבר מחמתו של המקדש, שהרי המקדש הוא שנתן לה את התמרה והיא רשאית לאכול את התמרה, שוב שפיר מקודשת כיון שהגיעה לה הנאה בעטיו של המקדש. ועיין בזה באורך בס' נתן פריו נדרים (לב ב).


 


The understanding of the Prisha that it is talking about a case where it is worth less than a שוה פרוטה and she is ספק מקודשת because it might be worth a פרוטה elsewhere - really we can say that it is talking about a case where it is worth a פרוטה and the reason it is only a ספק קידושין is because maybe the owner IS מקפיד.  


 


 


ד) והנה מה שכתב הפרישה דמיירי שאין בו שוה פרוטה ולכן מקודשת רק מספק דשמא שוה פרוטה במדי, באמת יש לומר דהוי רק ספק קדושין משום דחיישינן שמא בעל הבית מקפיד אף על תמרה אחת, דאין זה ברור שאינו מקפיד על זה, ועל כן מקודשת רק מספק דשמא אינו מקפיד, אבל לעולם יש לפרש שיש בו שוה פרוטה.
