A Bracha On A Tallis That Belongs To The Shul

Rav Tzvi Pesach Frank was asked if it is permitted to make a bracha on a tallis that belongs to the shul. 


 


 


 


The Mishna Brura [581 - 6] discusses the wrapping of a chazan in a tallis when he says selichos and cites the Taz that he should not put himself in a situation that presents a doubt [since he is wearing the tallis at night this is a ספק ברכה] and therefore he should not only not wear that tallis but he shouldn't wear his own tallis either but rather borrow from someone else. In that instance, he should have intention to wear it for the purpose of kavod and not to fulfill a mitzva, in which case he is definitely not obligated to make a bracha. We see from the M.B. that when he takes the communal tallis it doesn't help to have specific כוונה not to acquire it to exempt himself from a bracha. 


 


 


 


 


נשאלתי ע"ד טלית מצויצת השייכת לבית הכנסת והיא מוקדשת לצבור שיתפלל בה מי שירצה, אם רשאים להתעטף בה בלי ברכה כשמתכוונים לא לזכות. 


הנה, במשנה ברורה (סימן תקפא) לענין עטיפת הש"ץ בטלית באמירת הסליחות הביא בשם הט"ז שלא יכניס עצמו לדבר שיש בו ספק וע"כ לא יטול טלית שלו אלא יקח טלית של חבירו דבזה לכו"ע פטור מציצית ויכוין שנוטלו רק לכבוד ולא לקנותו. והמשנה ברורה הוסיף שגם טלית של הקהל לא יקח שהוא ג"כ כשלו. ומדבריו מבואר שאפילו אם הוא מכוין שלא לקנות אין זה מועיל בטלית של קהל. 




However, it is not so simple. Apparently, this would depend on the answers given by the gemara in Yoma [11b-12a] regarding the obligation of a shul in mezuza. 


 




 


בית הכנסת מי מטמא בנגעים והתניא יכול יהיו בתי כנסיות ובתי מדרשות מטמאין בנגעים ת"ל ובא אשר לו הבית מי שמיוחד לו יצאו אלו שאין מיוחדין לו


 



The Gemara raises another question: And with regard to a synagogue, does it become impure with the impurity of leprosy? But wasn’t it taught in a braisa: One might have thought that synagogues and study halls become impure with the impurity of leprosy. Therefore, the verse states: And the one whom the house is his will come; this is referring to a house that is designated for him, excluding those houses that are not designated for him but are public property.


לא קשיא הא ר"מ הא רבנן דתניא בית הכנסת שיש בה בית דירה לחזן הכנסת חייב במזוזה ושאין בה בית דירה ר"מ מחייב וחכמים פוטרין



The Gemara responds: This is not difficult, as it is the subject of a tannaitic dispute. This braisa, which states that a synagogue can become impure with the impurity of leprosy, is in accordance with the opinion of Rabbi Meir; that braisa, which states that a synagogue cannot become impure with the impurity of leprosy, is in accordance with the opinion of the Rabbis, as it was taught in a braisa: A synagogue in which there is a residence for the synagogue attendant is obligated in the mitzva of mezuza, as it is a dwelling. With regard to a synagogue in which there is no residence, Rabbi Meir obligates it in the mitzva of mezuza, and the Rabbis exempt it. Rabbi Meir deems a synagogue like a residence with regard to both a mezuza and its susceptibility to leprosy.

And if you wish, say instead a different resolution to the contradiction between the braisos with regard to the synagogue. Both this braisa and that braisa are in accordance with the opinion of the Rabbis, and it is not difficult. This braisa, which states that it can become impure, is referring to a synagogue in which there is a place of residence; that braisa, which states that it cannot become impure, is referring to a synagogue in which there is not a place of residence.


ואי בעית אימא הא והא דלית בה בית דירה



And if you wish, say instead yet a different resolution to the contradiction between the braisos: Both this braisa and that braisa are referring to synagogues in which there is not a place of residence,


והא דכרכים והא דכפרים




and this braisa, which states that a synagogue does not become impure, is referring to synagogues in large cities. Since those synagogues attract people from different places, the building is not the property of the local residents but that of the public. And that braisa, which states that a synagogue becomes impure, is referring to synagogues in villages, which belong solely to the residents of the village, and their status if like that of a house owned by partners.


 


 


 


According to one answer, we distinguish between כרכים and כפרים, and since a shul in a כרך doesn't have doesn't specific owners, it is not even considered as being under the ownership of partners and is thus פטור from mezuza. If we say that it has the status of a shul that belongs to partners and is obligated in mezuza, then we would also say about about a tallis that belongs to the community that it is like a tallis that belongs to partners which would make it obligated in tzitzis and thus necessitate a bracha. But if we say that it is considered LESS than a tallis of partners [as the gemara says about the communal shul of the כרכים], then when he has כוונה to acquire it he can make a bracha because with that in mind the tallis was donated. It is as if they specified that whomever takes it, may make a bracha [See Shulchan Aruch 658-7]. This is different than a case where he has כוונה NOT to acquire it where he may wear it without a bracha.   


 


 




 


אולם במקום אחר כתבתי שלכאורה דין זה תלוי בשני התירוצים שבגמרא יומא (דף יב ע"א) לענין חיוב ביהכ"נ במזוזה, אם דין ביהכ"נ הוא כשל שותפים או גרע משל שותפים. ולחד תירוצא בגמרא שם מחלק בין של כרכים לכפרים ומשום דבשל כרכים אין לה בעלים מיוחדים וגרע משל שותפים. ואם נאמר שדינו כשל שותפות ומאחר דטלית של שותפים חייבת בציצית הרי היא כטלית שלו דמחוייב לברך ואין מועיל מה שמכוין שלא לזכות בה. אולם אם נאמר שהוא גרע משל שותפות אלא כשהוא מכוין לקנותה יכול הוא לברך עליה משום שאדעתא דהכי הקדישו את הטלית וכאילו פירשו שכל אחד בשעה שיקחהו לצאת בו יהיה שלו (עיין שו"ע סימן תרנח סעיף ז), משא"כ כשהוא מכוין שלא לזכות בו, רשאי הוא להתעטף בלא ברכה. 


 


The gemara says [Chullin 136a]: 


 



מעקה אע"ג דכתב רחמנא (דברים כב, ח) לגגך דידך אין דשותפות לא


Similarly, with regard to the obligation of establishing a parapet [fence] around a roof, Rabbi Ilai concedes that the joint owners of a roof are obligated, even though the Merciful One writes: “When you build a new house, then you shall make a parapet for your roof [legaggekha],” using the singular pronoun, “and you shall not bring blood upon your house, if any man falls from there” (Deuteronomy 22:8). One might have inferred from the singular form that with regard to your roof, yes, one is obligated, whereas with regard to that which is owned in partnership one is not obligated.


 



כתב רחמנא (דברים כב, ח) כי יפול הנופל ממנו אלא גגך למאי אתא למעוטי בתי כנסיות ובתי מדרשות


Therefore, the Merciful One writes: “If any man falls from there,” indicating that wherever the danger of falling from the roof exists, there is an obligation to erect a parapet. The Gemara asks: Butif so, for what purpose does the term “your roof [gaggekha],”using the singular pronoun, come? The Gemara answers: It serves to exclude synagogues and houses of study.


 


 


 


Rashi explains that nobody has a personal stake in the shul because they belong even to people who live overseas. He adds that it is not a בית דירה - residence. What Rashi means in the first answer is that it is not possible to obligate one to build a מעקה when he has no portion in the building. So a shul that doesn't belong to anyone in particular cannot be obligated. That fits with the last answer in the gemara in Yoma that we saw which says that a shul of כרכים belongs to nobody in particular. The second explanation of Rashi that if it not a בית דירה then it is not obligated, fits with the answer in the gemara in Yoma that says that if a shul does not have a בית דירה then it can't become tamei with negaim.    


 


 


 


We can add that Rashi is consistent with his opinion in the gemara in Succah [27b] that if each person doesn't have a portion of a שווה פרוטה it can't be considered his. So too, if a shul that belongs to the entire world then of course people will not have a שווה פרוטה per person.  


 


 




 


ועיין רש"י (חולין דף קלו ע"א) לענין מעקה, דאיתא שם בגמרא דגג של שותפות חייב במעקה דכתיב כי יפול הנופל ממנו, אלא גגך למאי אתא למעוטי בתי כנסיות ובתי מדרשות. ופירש"י: בתי כנסיות שאין חלק לאחד מהן בו שאף לבני עבר הים הוא, ועוד שאינו בית דירה, עכ"ל. וראיתי למחבר אחד שבפעיה"ק שרוצה לדחות טעם הראשון של רש"י. אבל באמת דברי רש"י ברורין ומאירין דל"ש לרבות ולחייב גם כשאין לו חלק בבית. דלעולם עיקר המצוה לא רמיא אלא על מי שהבית שלו או כולו או מקצתו. ונמצא דב' לשונות שברש"י הן הם ב' התירוצים שביומא הנז'. ויש להוסיף עוד דרש"י לשיטתו בסוכה (דף כז ע"ב) דהיכא דלא מטי שוה פרוטה לכל אחד לא חשיב שלו כלל. וכן ביהכ"נ שהוא לכל העולם אי אפשר דלימטיה שוה פרוטה לכל אחד. ועיין ת' חמדת שלמה (או"ח סימן כז).
