Description

In the presentation of this chaburah on Shabbat, I noted that the first teshuvah of the Chatam Sofer and R' Meshulam Roth's teshuvah both lead to the conclusion that a Jew murdered was seemingly liable the death penalty. The liability is what brought about their death. However, this is a difficult position to accept, especially in the case of R' Roth's teshuvah as it deals with those killed in Holocaust. As such, I felt that the second (and chronologically later) Chatam Sofer was the most appropriate viewpoint. It is worth noting that R' Roth appears to note this difficulty latent within his position and strives to mitigate it by characterizing those killed as being tzaddikim in spite of their being liable the death penalty.
