For Masechet Bava Kamma 70a-b we will study the Mishna of 'incomplete testimony' in the case of a pair of witnesses that have no independent knowledge of the theft but only of the slaughtering or sale. Is this a controversy between Rebby Akiva & Chachamim who debate the validity of a pair of witnesses who only knows of one single year of Chazaka? Do the Chachomim who validate the testimony of a single year of Chazaka accept the principle of incomplete testimony? E. g. in the case of a pair that knows only of a single hair when Gadlus requires two hairs? In the 2nd part of our shiur we will discuss a kinyan act that engendered a capital punishment. Is the kinyan valid? Can the buyer compel the thief to deliver the stolen object?
