Description

For Bava Kama 59a-b we begin with a long Beraisa on the previous Amud that addresses the issue of how to evaluate damages & determine how much the damager pays the damaged. The Torah establishes that the precise amount of compensation to be paid - when my animal ate a patch of your tomatoes - is determined based on the market value of the field. To what extent was the field depreciated? Moreover, another element is added to the equation. We must multiply the actual damage by 60 and then divide it by 60. A major controversy arises regarding the q'; does the Nizak collect for 'futures'? The case is that the Mazik destroyed wheat or fruit in its early stage of growth. The wheat will have been worth much more had it reached maturity.
