Masechet Eruvin Live 85, finding the source for Rav and Shmuel's respective positions on the issue of תשמיש דרך האויר, is such a use of the רשות recognized even though it is a difficult and uncomfortable use. This will be relevant to the case of a cistern of water which can only be accessed thru the אויר.
