[ועיי"ש בר"ן שדן במחלוקת רמב"ם ורשב"א בדין ספיקא דאורייתא לחומרא, אי זה דין דאורייתא או דין דרבנן - ומחלוקת זו נידונה בריש ס' שב שמעתתא ובריש ס' שערי יושר.]
