Masechet Eruvin 99b, the Mishna of drawing water into his house from a cistern that has the status of a רשות היחיד but is located in the רשות הרבים. The Mishna also discusses the issue of throwing waste water from one's window out into a rubbish pile which is 10 Tefachim high but is located in a public domain. This will lead us to the case of the חצר that was bound by a pile of rubbish on one side and the ocean on the other. Do we consider the likelihood that the height of the rubbish will be reduced - making the אשפה into a רשות הרבים?
