Derech HaLimud: החפצא קובע את המעשה. When the law is inherent in the object, the definition of the action that generates the דין broadens. The object defines the scope of the action. Example in Aveilus for a parent the ripped garment may not be sown. This Issur may expand the definition of the prohibited act of fixing the garment. Such is the law in Hekdesh re: מעילה; even act of the agent accrues to the owner who sent the agent & the latter is in violation of Me'ilah. In the 2nd part of the shiur we will address the possibility that an act can be significant in of itself even without a Kiyum. Can there be a roof which has been equipped with a fence even without a technical (legal) Ma'aseh Mitzva?
