We begin with the Mishna in Masechet Bava Matzia 38a: Must the custodian do damage control & sell the spoiling produce? The Tana Kamma is opposed to it for one of two possible reasons. We seek to investigate the נפק"מ between these reasons. Rebby Shimon requires that the Shomer sell the rotting fruits, but what if he failed to do so? Is he liable as a negligent Shomer?
