For Masechet Bava Matzia 37b we will discuss the principle of ספק ממון according to R' Akiva. One position of R"A has it that the money is left in the hands of the מוחזק who is being sued. Therefore if it is unclear who is the rightful heir we leave the possessions where they are (in the hands of the Muchzak). Another position of R"A in the case where the thief is unsure of the identity of his victim, the Gazlan must return the money to all possible candidates. How are we meant to reconcile the seeming contradiction between these two statements of Rebby Akiva?
