Our sugya in Masechet Bava Metzia 31a-b at the very beginning of the 2nd Perek addresses the question: when is the finder permitted to keep the found object? iF THE OBJECT BELONGS TO A CATEGORY OF UNIFORM OBJECTS, i.e. there is no identifying siman, the finder can keep the object. This is due to the reality of יאוש, i.e. the owner despairs of retrieving his property & gives up hope.
