For Masechet Niddah 14a & 57b we seek to reveal the difference between כתם and עד שאינו בדוק. This will require that we introduce a framework: two fundamentally different categories of Rabbinic laws, one is defined as an extension of a Torah law, the other is a brand new entity. Whereas the first category requires that the rules and conditions set by the Torah apply, i.e. כל דתיקון, the second category works with its own set of conditions, i.e. הם אמרו והם אמרו, the Rabanan will set their own rules. Acc to Tos' כתם is a brand new Niddah DeRabanan & is governed by its own rules. In contrast, עד שאינו בדוק operates as an extension of the category of Nidddah DeOraisa. This is the view of the Achronim in explaining Rebby Chiya.
