Does the Halacha recognize the sale of the שור המזיק by its owner, the Mazik, or does the Nizak have rights in the animal that block the ability of the Mazik to sell the animal? What if the Mazik declares the animal Hekdesh? What kind of Hekdesh? the sugya in Masechet Bava Kamma 33b addresses the issue of the ownership rights of the Nizak & the Mazik over the שור המזיק. This sugya is a further extension of the great debate between Rebby Akiva & Rebby Yishmael that we began yesterday. Does R' Yishmael recognize that the Nizak owns a שעבוד in the animal, this despite the fact that animals are Metaltilin (movables).
