Description

The mishna and the sugya in Masechet Kiddushin 64a-64b addresses the following question: is the father believed to testify that he accepted Kiddushin or Gerushin on behalf of his daughter, either a קטנה or a גדולה? Or that his daughter was captured by the non-Jews and can no longer marry a Kohen? Does the father have the status of בידו which gives him credibility? Under what circumstances does the father have the בידו, i.e. the ability to marry her off to one who will disqualify her to Kehuna? Perhaps the father is believed simply because the Torah said so! Regardless of בידו!! Does a husband have credibility to establish that his wife will or will not require Yibum? Will it depend upon the assumption of her status, i.e. her חזקה?
