The sugya in Masechet Kiddushin 43a-b continues its project of finding the source for the rule אין שליח לדבר עבירה. In the latter part of the sugya the Gemorah presents the radical view of Shamai HaZaken to the effect that יש שליח לדבר עבירה. Is this a unique Halacha in עבירת רציחה or a general Halacha regarding all Aveiros? What חיוב is Shamai referring to? Can we put the משלח to death in a court of law? Or is he discussing the ethical liability in the Heavenly Court? I.e. חיוב בידי שמים? Wouldn't the Chachamim admit to the ethical responsibility of the משלח? After all one who hires false witnesses is held responsible in the בי"ד של שמים. What then is the subject of the controversy between Shamai & the other Tanna?
