We will continue our Halacha shiur on the issue of חטא בשביל שתזכה חברך: Does one violate a minor Issur in order to prevent someone else from violating a severe Issur? We will study the case of Shimon who - because of his פשיעה (negligence) - exposed himself to the danger of a severe violation. We are not talking about forced apostasy but one who went off with the גויים on his or her own volition. The שו"ת נחלת שבעה claims that according to the Beit Yosef, based on a שו"ת הרשב"א, in such a situation we are not permitted to violate an Issur on behalf of the פושע. The Nachlas Shiva disagrees with this position and permits the violation. The Mishna Brura quotes the various opinions & will only permit the violation of an איסור דרבנן.
