Description
We will study the Halachik principle: כופין על מידת סדום. We will study two of the contemporary responsa on this issue. The Emek Mishpat, Hilchot Shechenim, addresses the question of one neighbor (Reuvein) who wishes to build a porch over the air space of the other neighbor in a case where the latter suffers absolutely no loss. Can Reuvein base his case on the principle of Midat Sedom which would force the hand of his neighbor to permit him to extend his porch since the latter suffers no loss? We will study a second Teshuva, that of the Mishpatei HaTorah, regarding someone who shows up at hotel at a late hour and sleeps in a room (using his own linens), can the hotel demand that he pay for the night (even thou they lost nothing?
