Description

The second principle formulated by the opening Mishna in Perek Kol HaBasar is the Gezeira enjoining us from placing meat - even chicken - and cheese on the same table. The sugya in Masechet Chulin 104a wonders if the Issur Ha'ala'ah (העלאה) in the case of chicken is based on the premise that chicken & milk is DeOraisa. Otherwise העלאה is a גזירה לגזירה and we adopt the principle of אין גוזרין גזירה לגזירה. Abaye will defend the position that chicken is DeRabanan yet העלאה applies to chicken nonetheless. Our Abaye is consistent with his position in Masechet Shabbat 10a that just as one is prohibited by virtue of גזירה from standing in Rshus HaRabim & drinking in Reshus HaYachid, the same applies if he drinks in a Karmalis. כולה חדא גזירה היא
