In the sugya of trapping a Chilazon & removing its blood, Rashi says that in a case of Davar She'eino Miskavein Rebby Shimon would admit that one is חייב in a Psik Reisha situation as long as its Lo Ichpas Lei, i.e. he couldn't care one way or the other. Tos' argues that in the case of Lo Ichpas Lei, Rebby Shimon would say you are פטור because it's a Melacha She'eino Tzricha LeGufa. We will try to explain the position of Rashi. We will continue by examining the sugya of pouring cold water into a hot pot which strengthens the pot. The sugya assumes that Shmuel cannot accept both the position of R' Shimon on Davar She'eino Miskavein & the view of R' Yehuda on Melacha She'eino Tzricha LeGufa. We will try to explain the premise of the sugya.
