Description
In this shiur for Masechet Makot 15a: we will establish that the violation of a Lav Shekadmo Aseh, e.g. a Tameh that enters the Mikdash, engenders Malkot and is classified as Dumya (similar) LeLav DeChasima. The added Aseh does not alleviate Malkos; on the contrary, the violation is even more severe. The violation of a Lav She'nitak LeAseh, however, does not generate Malkot because the purpose of the Aseh is to substitute the Aseh for the Onesh of Malkot. In the case of 'Oneis' we apply the principle of Lav Shenitak LeAseh because כל ימיו בעמוד והחזר קאי. This principle leads to the main issue regarding Lav Shenitak LeAseh, i.e. is the Averas HaLav complete with the Bitul Aseh, or does the Kiyum HaAseh rectify the Lav & alleviate Malkot?
