The central principle of Melacha on Shabbat is Melechet Machshevet, a term derived from the Mishkan. The p'tur of M"M applies in Mekalkel (a destructive act) and in Melacha She'ayna Tzricha L'Gufa. We will investigate the P'tur of Davar She'eino Miskavein, according to Rebby Shimon, is this a universal p'tur that applies to all Issurei Torah, or is it a separate Halacha in Shabbos derived from Melechet Machshevet? THE DIFFERENCE IN HILCHOS SHABBOS WILL BE IF THERE IS AN iSSUR DERABANAN. We derive from many sugyot that Rebby Shimon is Matir other Issurim because of the lack of Kavana.
