In this shiur we will study the Sugya of Genevas Da'as, situations in which Shimon is mislead by Reuvain into believing that Reuvain did a favor for him, when in fact he did not. We will study the controversy between Rashi and Tos' regarding the scope of Genevas Da'as. Does it apply to situations where the recipient mislead himself, i.e. the seller did nothing actively to mislead the buyer. Does the buyer have to anticipate the fact that the recipient would draw the mistaken conclusion and set the record straight? Can I invite you when I know well that you cannot take me up on the offer? Can I open a bottle of wine for the guest when I would have opened it anyway? Do I have to tell my friend that I was leaving town anyway, not to greet him?
