Introduction to Massechet Makkot. Is the belief in the testimony of the second pair of witnesses logical or is it simply a Gezeras Hakasuv, a Divine decree? We will study the Ramban who presents the rational for the credibility of the Mazimim and the establishment of the first pair as Zomemim. The Ramban splits the concept of eidus, breaking it down into two categories. There is testimony on the facts of the case, relevant to the Nidon; and there is testimony on the witnesses themselves. In this shiur we will analyze the difference between HaZama & Hakchasha. We will study the Rambam's presentation of Hazama in the 18th Chapter of Hilchos Eidus. According to the Ramban hazama is a Gzeras HaKasuv. Is this the issue that divides Abaye & Rava?
