Description
Kedushat E"Y is engendered by a process that has Halachik status. That process may be military conquest or settlement. But what is E"Y without a Halachik "mekadesh"? The Rav used the term "Shem" E"Y to convey the concept of E"Y in and of itself, a Land that is the eternal national possession of the Nation of Israel. The Shem E"Y expresses itself in the mitzvos of Egla Arufa, Smichas Chachamim, and Kiddush HaChodesh. As a result, even territories that were included in the conquest of the Land at the time of Moshe & Yehoshua attain the status of Shem E"Y for these mitzvot despite the fact that they were not settled by the Olei Baval.
