We will study the explanation offered by the Ktzot as to why Rashi rejected the Rivam and insisted that the seller retained the tree and sold the second half of his field where the buyer digs his Bor. In this context we will analyze the insight of the Ramban that if the Nizak is innocent he can sue the Mazik for Harchaka despite the fact that the Mazik is guiltless.
