The leniency of אין טוחן אחר טוחן doesn't appear in the Gemara. Some Rishonim (Ran, Rashbam, הגהות מיימוני, the Yeraim) allow it. The Rema holds of this leniency in the context of grinding bread (which is made of ground grain). The Rashba and the Ran allow grinding bread only when eaten immediately. From the fact they do not allow it because of אין טוחן אחר טוחן implies they do not hold of the leniency. The Mishnah L'Melech infers from the Rambam (that holds בל יראה gets מלקות) that he does not allow grinding bread at all.
