The shiur will divide into two parts: a study of Tos' Marchikim, what is the relationship between the two halves of the Tos'? And a study of the Machloket regarding MeCha'ah and Chazaka, which causes which? We will examine the opinion of the Rosh in light of the Sugya which requires one to declare a Mecha'ah against his friend who is legitimately eating the fruits of his field. And the opinion of Rabeinu Yona in light of the Sugya which establishes that a husband eating the fruits of his wife's field does not establish a Chazaka despite the lack of Mecha'ah on the part of his wife. We will study the approach of the Ktzot to resolve the contradictions in the opinion of the Rosh.
