This shiur will focus on the relationship between the Machloket between the Rabbanan & Rav Yose and the Machlokes between Abaye & Rava in both versions of the latter controversy. The central question to be addressed is: what triggers the obligation of Harchakas Nezikin? Is it the object (cheftza) in danger of being damaged, the legal rights of the Nizak to enjoy his property, or the MaAseh Hezek? Or perhaps the future inevitability of the Hezek generates Harchaka. These possibilities will be explored in this shiur.
