This shiur will address two issued relevant to the requirement of Harchakas Nezikin. One - Would Reb Yose - who places the burden of Harchaka onto the shoulders of the Nizak in the case of Reuvain who plants a tree which threatens to undermine Shimon's Bor - impose the obligation of Harchaka onto Reuvain who plans to dig a Bor that threatens to undermine Shimon's Bor? If so, why? Two - How does Tos' apply the principle of "Girei Dilei" to the case of Reuvain's digging the Bor when Shimon hasn't yet dug his Bor? Where is the act of Hezek if the Cheftza HaNizak does not yet exist? We will attemp to resove these issues based on a "revolution" presented by Rabbeinu Yona.
