Description

The defendant refused to pay for the wall when the plaintiff demanded - in the presence of two witnesses - that he do so. Can the defendant claim that subsequently he paid? What is the root of the issue? What does Tos' hold with regard to a Chazit in a Chatzer? Below 4 Amot, and above? Why does the defendant pay for the wall if he built a wall next to the wall built by his neighbor? Why not apply the principle of "Ze NeHeneh V'Zeh Lo Chaser"?
