Description

Tosfot and other Rishonim question why the Mishna needs לפיכך. Tosfot assumes that even without the compulsory requirement to build the wall, the law would be יחלוקו, meaning we would divide the wall when it falls into the backyard of Reuvain. Reuvain would not be believed – despite his possession of the stones – to claim “I built the wall with my $ on my backyard”. He proves this from the case of בקעה. The Rashba distinguishes between בקעה and חצר.
