The opinion of Tos must be analyzed and clarified. On the one hand, Chachamim set a standard for the width of the wall and this standard trumps the Minhag. Therefore the defendant need not build a wall of seven tfachim despite the claim of the plaintiff that the minhag in that particular area is seven. Nevertheless, the defendant can win his argument to build a wall of five tfachim if that be the local minhag. And this despite the fact that the chachamim set the standard at six tfachim. How do we reconcile this inconsistency?
