      See Rabbi Tendler's article in the Beit Yitzchak 38 תשס"ג he has a similar explanation. Also one can make a DIYUK in RASHI when he uses the term פיקדון i.e the DAM is temporary. It's a very nice CHIDDUSH. Chaim Hoffman
