מהן מדברי תורה ומהן מדברי סופרים. וברמב"ם (מאכלות אסורות פ"ט ה"ד) איתא שבשר חי' אסור מדרבנן, אמנם עי' בכס"מ שבהלכות ממרים (פ"ב ה"ט) כתב דבשר חי' מן התורה. וע' בשו"ת הרדב"ז (ו' שני אלפים קמא) מה שהסביר שכוונתו בהלכות ממרים רק שמי שאומר כן אינו עובר על בל תוסיף דאיכא קרא דמסייע ע"ש.
