Description

Note: There is also the view of the ר״ן, who is a more conservative alternative to the רי״ף-position. He thinks the ספק about שלוחו בבעלים is never resolved, and is therefore treated להלכה as a קולא לנתבע in בעליו עמו, as it is a monetary issue (so in effect we’ll treat it like בעליו עמו), whereas in איסורים (such as הפרת נדרים), we’d go לחומרא and thus the שליח cannot be מיפר. This position as well puts pressure on the רי״ף whose view we’ve undertaken to explain.
