לפי הר"ח יש תקנת בית דין כשיש מעשה ספק מפני שהעדים לא באו עד יום שלושים ואחד ומחמת זה שמרו שני ימים שאז זה נהיה קדושה אריכתא. אלא שבבית הועד אם קדשו יום שלושים אז אין מעשה ספק ולכן ראש השנה הוא רק יום אחד. אמרנו שבעצם יש תקנת בית דין שראש השנה תמיד יהיה שני ימים, אלא שבבית הועד יש מצב חריג והוא יוצא מן הכלל ויש רק יום אחד של ראש השנה מפני שאין מעשה ספק. היה עדיף לבטא את זה אחרת. כל התקנה לשמור שני ימים של ראש השנה כקדושה אריכתא היא רק כשיש מעשה ספק. שמעשה ספק מחדש שיהיו שני ימים בתורת קדושה אריכתא. ולכן כשאין מעשה ספק אז שומרים רק יום אחד של ראש השנה.
